High Court: The High Court has asked the Honors and Awards Committee to consider the application of the son of an army officer who was martyred in the Indo-Pak war 58 years ago and who has been promoted posthumously. The High Court said that the committee can consider expediting the process and give its decision within three months. It said that the facts of this case are unique and pertain to a war that took place almost 58 years ago, therefore, this order shall not be treated as a precedent.

Sacrificed his life in the Indo-Pak war of 1965

The order came on a plea by retired Brigadier NB Singh that his father Major Mohan Singh had sacrificed his life in the Indo-Pak war of 1965 and should be considered for the gallantry award. The counsel for the petitioner submitted that though Mohan Singh was a Captain at the time of his martyrdom, he was posthumously given the rank of Major, and this in itself is an acknowledgment of the gallant act of the army officer.

The matter should be taken to its logical conclusion

A bench of Justice Najmi Waziri and Justice Sudhir Kumar Jain was informed by the counsel for the petitioner that the case of his client’s father was not considered by the appropriate committee and the matter should be taken to its logical conclusion, i.e. Major Mohan Singh was awarded the gallantry award. Rewards should be given. The bench said- In the relevant circumstances, this appeal should be considered as a representation of the appellant by the Honors and Awards Committee at the Army Headquarters level.
