NGT serious about Jamshedpur’s garbage dumping case, sought affidavit, next hearing on March 14

Jharkhand News: NGT (National Green Tribunal) has taken it seriously while hearing the petition of Sonari resident KS Upadhyay against the pollution caused by dumping and burning garbage on the banks of Subarnarekha river near Sonari Domuhani, Jamshedpur under East Singhbhum district. Judicial Member B Amit Sthelkhar, Expert Member Dr. Afroz Ahmed of NGT’s Eastern Zone Kolkata Bench, while hearing the complaint of the plaintiff KS Upadhyay, said that it is surprising that despite the findings of the Regional Officer of the Pollution Control Board, Jamshedpur, the Jharkhand State Pollution Control Board has No remedial measures have been suggested and no inspection report has been filed.

Bench angry with Jharkhand State Pollution Control Board’s apathy

The bench said in the order that the Jharkhand State Pollution Control Board and its officials show apathy and non-seriousness. The NGT warned the Jharkhand State Pollution Control Board that they should face serious consequences for filing such careless affidavits. Therefore, the Bench directs the Jharkhand State Pollution Control Board to take remedial measures and actions to be taken by the violator along with filing of the inspection report by the respondent no.1 Pollution Control Board.

Order to file affidavit within two weeks

The bench ordered the board officials to file an affidavit for this within two weeks. At the same time, Vijaya Jadhav, Deputy Commissioner of East Singhbhum, the second defendant in the case, appeared virtually. On his behalf, advocate Aishwarya Rajeshwari has sought two weeks’ time to file a counter-affidavit before the NGT. The Deputy Commissioner has been ordered to file an affidavit in the case on March 14, 2023. Now the matter will be heard on March 14. Supreme Court’s preferred advocate Sanjay Upadhyay, advocate Soumitra Jaiswal appeared virtually and argued on behalf of Sonari resident KS Upadhyay in the NGT court.

Allegations of endangering the lives of citizens

KS Upadhyay, a resident of Sonari, has filed a case in the NGT, naming the Central and State Pollution Control Board, Deputy Commissioner of East Singhbhum, Jamshedpur Axis and Tata Steel Utilities and Infrastructure Services Limited (erstwhile JUSCO) as respondents. In his petition, he accused all of the above of putting the lives of citizens at risk by violating the relevant provisions of the Environment Protection Act.
