However, a division bench of Justice Sanjiv Khanna and Justice Dipankar Dutta said that they have some objection to the High Court's order that ED. was not given full time to give his answer but despite this the court does not want to interfere in this matter.
However, we are not prepared to interfere with the impugned order. Therefore, the special leave petitions are dismissed. The Supreme Court also made it clear that when any criminal offense is registered, the ED. will be allowed to proceed.
