Mumbai, The Bombay High Court has extended the temporary stay on the demand for penalty and show cause notice sent to industrialist Anil Ambani by the Income Tax Department under the Black Money Act till further orders.

A division bench of Justices Gautam Patel and Neela Gokhale granted time to the Income Tax Department to file its reply while fixing for April 28 the hearing of Ambani’s plea challenging the notice and penalty. The High Court had in September 2022 put an interim stay on the show cause notice pending hearing.

In March this year, Ambani’s lawyer Rafiq Dada told the court that the department later also sent a notice demanding the fine to his client. After this, the court also put an interim stay on the demand notice.

After the hearing began on Wednesday, advocate Akhileshwar Sharma, appearing for the Income Tax Department, sought two weeks’ time to file a ‘comprehensive affidavit’ in response to the amended petition.

Sharma said, “The petition has been amended by adding some more respondents and attaching some new documents. The department seeks time to file a comprehensive affidavit.” The court has directed to file the affidavit by April 21.

The petition has been listed for hearing on April 28. The Income Tax Department had on August 8, 2022 issued a notice to Anil Ambani for alleged evasion of Rs 420 crore in tax on undisclosed wealth of over Rs 814 crore allegedly kept in two Swiss bank accounts.
