The Punjab-Haryana High Court has granted bail to a woman accused of smuggling 55 kg of poppy seeds on the grounds of pregnancy. The High Court held that pregnancy is a special circumstance and on that basis the seriousness of the offense can be temporarily ignored while granting bail.

While filing the petition, the woman said that an FIR was registered against her under the NDPS Act in Ludhiana on June 2. According to the allegation, the petitioner was caught with 55 kg of poppy. The earlier bail petition filed by the petitioner has been rejected. Some time ago the petitioner came to know that she was pregnant and therefore she did not want the child to be born in prison.

After hearing all the parties, the High Court said that the birth of a child in custody is not only painful for the mother but also for the birth of the child, because whenever the child is questioned about his birth, his There is always a negative effect on the psyche. A woman's pregnancy is a special situation in which the seriousness of the crime can be temporarily overlooked.

The High Court said that while deciding the bail of a pregnant woman, the interest of the unborn child should also be kept in mind, which is not expected to be born in jail. In such a case, bail should not be refused unless it is clear that the petitioner poses a serious risk in being released on bail. With these comments, the High Court has approved the petition and granted bail to the petitioner.
