The special court had awarded the death sentence
On December 17, 2019, a three-judge special court comprising Justice Waqar Ahmed Seth, Justice Nazar Akbar and Justice Shahid Karim convicted former president and military ruler Pervez Musharraf of sedition under Article 6 for violating the Constitution. After this, Musharraf was sentenced to death in absentia.
Lahore High Court has canceled the death sentence
However, the Pakistan Army expressed displeasure over this decision of the special court. After this, the Lahore High Court canceled Musharraf’s death sentence. The special thing is that on January 9, 2020, the Lahore High Court declared the formation of the bench of the special court as unconstitutional. According to the Lahore High Court, the special court was constituted without the approval of the Cabinet. Taking this as a basis, the court declared it unconstitutional.
The Sindh High Court appealed to reinstate the sentence
Following the Lahore High Court’s decision to declare the special court verdict unconstitutional, the Sindh High Court Bar Association challenged it on January 13, 2020. In it, the association demanded the cancellation of this decision. The petition states that the decision of the Lahore High Court is contrary to the law laid down by the apex courts as well as the order passed by the Supreme Court in the Lahore High Court Bar Association case of 2019. In it, the Supreme Court was appealed to restore the punishment given to Musharraf by the special court in the case of destroying the constitution.
The hearing on the death penalty will be held after 9 months
Now after 9 months of Pervez Musharraf’s death, the appeal to cancel his death sentence will be heard. According to information, a four-member bench of Pakistan’s Chief Justice Qazi Faiz Isa, Justice Syed Mansoor Ali Shah, Justice Aminud Din Khan and Justice Athar Minala will hear the matter. It may be mentioned that Musharraf, through his lawyer Salman Safdar, filed an appeal in the Supreme Court and appealed to cancel the sentence. In the petition, it was said that the case was not related to the constitution, it was tried in an unconstitutional manner.
Died of illness in February 2023
It may be mentioned that former President of Pakistan General Pervez Musharraf died in Dubai in February 2023 due to illness. Kargil war was fought between India and Pakistan in the year 1999.
