New Delhi/Mumbai. Eknath Shinde has won in the Election Commission. The Election Commission on Friday ordered that the name of the party be retained by the Shiv Sena and the party symbol bow and arrow by the Eknath Shinde faction. This result of the Election Commission is being considered as a big blow for Uddhav Thackeray.

The Election Commission of India observed that the present constitution of Shiv Sena is undemocratic. It has been distorted to undemocratically appoint people of a faction as office bearers without any elections. Such a party structure fails to inspire confidence.

The Election Commission found that the constitution of Shiv Sena as amended in 2018 has not been given to the Election Commission of India. The amendments undo the work of introducing democratic norms in the 1999 party constitution brought in by the late Balasaheb Thackeray at the commission’s insistence.

The Election Commission also observed that the undemocratic norms of the Shiv Sena’s original constitution, which was not accepted by the commission in 1999, have been brought back in a clandestine manner, reducing the party to a fiefdom.

It will be interesting to see the effect of this decision of the Election Commission on the ongoing hearing in the Supreme Court. The hearing was going on in the Supreme Court for the last three days on the issue of disqualification of the MLAs. In this hearing, Mahesh Jethmalani and Harish Salve on behalf of Shinde said that we have not violated the anti-defection law, but it is a democracy within the party.

He claimed that we are the real Shiv Sena and the matter is with the Election Commission. Now that the Election Commission has given Shiv Sena party and symbol to Eknath Shinde, Eknath Shinde can give this certificate even during the Supreme Court hearing.

The Election Commission has given us the name and symbol of the party, so how can the anti-defection law be implemented, Shinde’s lawyer will claim in the Supreme Court hearing.
