The Delhi Commission for Protection of Child Rights (DCPCR) has demanded same-sex marriage petitions in the Supreme Court to allow same-sex couples to adopt a child. Let us tell you that this commission comes under Delhi government. In the Supreme Court, a constitution bench headed by Chief Justice DY Chandrachud will hear the matter on April 18. Recently, the Central Government had opposed a petition in the Delhi High Court giving legal recognition to same-sex marriage.

The Delhi Child Rights Protection Commission has said in its application filed in the Supreme Court that it has 15 years of experience in protecting the rights of children. The petition said that in more than 50 countries of the world, same-sex couples have been allowed to adopt a child. The commission is qualified to assist the Supreme Court on the impact of same-sex marriage on children. Demanding recognition of same-sex marriage, the commission has said that all the studies show from psychological point of view that same-sex couples can prove to be good parents.

What is the stand of the central government?
Many petitions have been filed in the High Court regarding the demand to approve gay marriage. Two women are also involved in filing these petitions. They are living together like partners for the last several years. Both of them want same-sex marriage to be approved. But, the central government has been arguing that same-sex partners living and having sex cannot be compared to an Indian family, which consists of a husband, wife and children. In this system the biological man is the husband and the woman is the biological wife and after their union a child is born.

Is homosexuality a crime in the country?
Until two years ago, homosexuality was considered a crime in the country. According to section 377 of the IPC, whoever has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment of either description for a term which may extend to ten years, or with imprisonment for life. But, on 6 September 2018, the Constitution Bench of the Supreme Court, giving a historic verdict, refused to consider homosexuality as a crime.

The Delhi Commission for Protection of Child Rights has been constituted under the Commission for Protection of Child Rights Act, 2005. It consists of six members and a chairman. Same-sex marriage is not legal in India. In gay marriage, two people of the same gender marry each other. In this, two girls marry each other or two boys marry each other.
