Modi surname case: Rahul Gandhi’s petition will be heard today

A bench of justices BR Gwai and Prashant Kumar Mishra will hear the petition of Rahul Gandhi in the PM Modi surname case in the Supreme Court today. On July 15, Rahul had filed a petition for an urgent hearing of the matter.

The court accepted on July 18. BJP MLA Purnesh Modi, who had filed a case against Rahul before him, had also filed a caveat and appealed that a decision should not be taken in this case without hearing him. Senior advocate Abhishek Manu Singhvi will appear for Rahul Gandhi. If Rahul does not get relief from the Supreme Court, he will not be able to contest any election till 2031.

It is a rule that there is a ban on contesting elections for six years after the completion of the sentence. In this case, the 2-year sentence and after that the 6-year sentence will be completed in 2031. On March 23, 2023, the Sessions Court of Surat sentenced Rahul Gandhi to 2 years in the defamation case. Rahul Gandhi went to the High Court against this decision, but the court refused to stay his sentence.
