Exceptions to the planning of public recruitment (circular)

The Ministry of Interior has published a circular on exemptions from the annual planning of recruitment in public, from July 1, 2023.

In particular, the circular is about exemptions from the annual recruitment planning and bears the signature of the secretary general of the ministry, Ms. Paraskevi Charalambogianni.

The circular states the following:

  • expires of the decision to extend the act of the cabinet, “Suspension of appointments
    and recruitment in the Public Sector”
    only until 30 June 2023
  • is abolished the special provision that provides recruitment of staff as an exception to the Commission’s approval process

Exceptions

The exemptions from the public’s annual human resources planning, which will come into force from 1 July 2023 are as follows:

  • The staff of the Presidency of the Republic and the Hellenic Parliament
  • The notaries and lawyers only for their appointment to the relevant Associations for the exercise of their profession
  • The transferred employees, the e’spersonal advisors, special partners which are equated in terms of consequences with transferred employees and whose positions are provided for by the written provisions, as well as the personnel referred to in presidential decrees
  • The journalists in the press offices of the ministries
  • THE task assignment for interpretation at conferences, workshops, committees, discussions with representatives of foreign countries or organizations or the European Union and generally in any case where interpretation is required, as well as for case-by-case translations of texts (documents, codes, official brochures, etc.)
  • Oi sfixed-term, project or hourly compensation contracts for the teaching staff of the National Center for Public Administration and Self-Government, and the Education Unitss or Training Schools of Ministries and Public Law Legal Entities
  • The researchers, the technical and specialized scientific staff of the Research Institutions and the Hellenic Atomic Energy Commission, project assignment contracts, for the needs of research programs from these Institutions, as well as the staff employed and providing services in projects or programs financed through the Special Accounts of Higher Education Institutions or Private Legal Entities for the utilization and management of the property and research funds of A.E.I. or from European or international or own resources or private funds
  • The appointed or employed in execution of judicial decisions
  • The staff of special categories, as long as their appointment/re-appointment or recruitment or re-hiring is required by an express provision of the law, without leaving a stage of discretionary assessment to the competent administrative authorities
  • The doctorsduty bound countrysidethe qualified doctors who are hired in positions equal to those vacated by the departure of doctors of corresponding categories
  • The project contracts of up to 1 year of all kinds of its artistic staff E.R.T. S.A.as well as the employment of artistic, technical and technical staff with a fixed-term or project contract in state theaters and orchestras, the Opera House as well as the Hellenic Festival SA., for specific performances or other artistic events, according to an approved program.
  • The staff of joint-stock companies, for which the provisions of Chapter B of Law 3429/2005 (A’ 314) apply, as well as those appointed directly to managerial positions in legal entities.
  • The single-member and collective management bodies
  • The staff hired to carry out a special employment program announced and subsidized by the Public employment Service (DYPA, former OAED)
  • The personnel hired for a specified period of time, which cannot exceed the project completion schedule, and for the execution of specific archaeological works on monuments or rescue excavations, which are implemented using the archaeological self-surveillance method and which are co-financed by operational programs of NSRF or are implemented in the context of other EU or international programs.
  • The fixed-term work contracts or project leases to meet emergency needs at the country’s borders due to increased immigration pressures.
  • The project lease contracts that are co-financed within the framework of NSRF, EEA programs or in the context of other EU or international programs or in the context of self-financed research or development programs, as well as the labor or employment contracts of private law personnel hired for a certain period of time or for hourly employment for the execution of the aforementioned co-financed operations or self-financed programs or of the programs financed by own resources or by private bodies and their renewals and extensions.
  • The project lease agreements, the labor or employment contracts of private law personnel hired for a certain period of time or for hourly employment to carry out archaeological work on monuments or rescue excavations carried out using the archaeological self-surveillance method in the context of the implementation of EPA programs, as well as renewals and extensions them, without it being possible to consider that permanent and permanent needs are covered by these contracts (also in accordance with par. 1 of article 4 of PYS no. 33/2006).
  • The employment contracts of private law for a period of time up to 8 months to address unforeseen and urgent needs.
  • The staff hired for employment up to 5 days’ wages per monthas provided for in article 210 of Law 3584/2007.
  • The staff who is recruited pursuant to paragraph 2 of article 206 of Law 3584/2007 on the recruitment of an employee of a corresponding specialty, to address urgent needs.
  • The Fixed-term Private Law personnel of a remunerative nature, as well as the Private Law Fixed-Term staff and the contractors whose payroll expenses are covered by income in the form of remuneration or other compensations, or exclusively from own resources or private funds, (para. d of par. 3 of article 25 of Law 4829/2021).
