It may be mentioned that the central government has issued an ordinance regarding the rights related to the transfer, posting and vigilance of officers in the capital Delhi. Now the right of transfer and posting of officers will go to the hands of the Lieutenant Governor. In fact, the Supreme Court in its decision of May 11 had given the Delhi government the right to transfer and post officials.
The Center has overturned this decision of the court through an ordinance. Later, a law in this regard will also be made in the parliament. Earlier on Friday evening, Arvind Kejriwal had asked whether the central government is plotting to overturn the orders of the Supreme Court. By night, this fear of Kejriwal proved to be true.
The Union Ministry of Law and Justice has issued an ordinance for matters related to transfer-posting of Delhi government officials. The Government of National Capital Territory of Delhi (Amendment) 2023 Ordinance has created a permanent authority for the Union Territory of Delhi. The Chief Minister of Delhi and the Chief Secretary and Principal Secretary Home will be part of this authority.
This authority will forward its recommendations to the Lieutenant Governor of Delhi for taking decisions related to transfer, posting, vigilance and general affairs. The Center issued this ordinance after the Supreme Court’s verdict on transfer-posting. This Ordinance has been brought to maintain a legal balance in the interest of the nation and the Union Territory of Delhi. It has been said in the ordinance that this arrangement will strengthen the expression of democracy at the Center and Delhi.
