In a letter to the Prime Minister, the Chief Minister said that it is very unfortunate that the Central Government has issued instructions to the Chairman of Bhakra Beas Management Board (BBMB) in this regard on May 15, 2023. He said that in these instructions, the Government of India has given BBMB. ordered the chairman of NOC The present system of giving should be abolished on the condition that the Himachal Pradesh government will have to take less than the 7.19 percent share of total water as fixed by the Supreme Court for electricity.
Bhagwant Mann further said that B.B.M.B. Will study only the technical feasibility of taking water from Himachal Pradesh for water supply/irrigation projects, that too if it involves BBBM. includes engineering framework and necessary technical requirements shall be conveyed to Himachal Pradesh within 60 days of its receipt. Bhagwant Mann said that the issue of water distribution is an inter-state dispute and states cannot issue unilateral instructions regarding water distribution.
Punjab Chief Minister further said that BBMB It is constituted under Section 79(1) of the Punjab Reorganization Act-1966 according to which the Board can only carry out administrative functions, maintenance and operation of Dam and Nangal Hydel Channel and Irrigation Headworks at Ropar, Harike and Ferozepur. He said that according to this act, BBMB Water from rivers is not authorized to be given to any state other than partner states and in this case Himachal Pradesh is not a partner state. Bhagwant Mann said that the water of Sutlej, Ravi and Beas rivers has been allocated to Punjab, Haryana, Jammu and Kashmir and Rajasthan through various agreements and Himachal Pradesh cannot lay any claim on the water of these rivers.
CM Mann said that the water of these rivers is earmarked for specific areas of the partner states and this earmarked water is supplied through a special canal system. He further said that under entry 17 of the Provincial List-2 of the Constitution, water is the issue of the states and the right to determine or decide the rights of river waters is vested in the Central Government as per the proposal of the Inter-State Disputes over River Waters Act, 1956 made under Article 262 of the Constitution. The tribunal constituted on the complaint of the state government will be under the jurisdiction. Bhagwant Mann said that partner states like Punjab, Haryana and Rajasthan have been liberally providing drinking water to Himachal Pradesh through inter-state canal channels in the past.
He further lamented that the Government of India has also included irrigation schemes in the instructions. He reminded that during the previous years BBMB gave permission to release water to Himachal Pradesh on 16 occasions. Bhagwant Mann said that the current situation when the rivers are decreasing rapidly year after year and all the partner states like Punjab, Haryana and Rajasthan are continuously demanding to increase water, then the Indian government should reconsider this unilateral decision. And it needs to be taken back.
