American court gives big relief to H-1B visa holders

Spouses of H-1B Visa Holders: A judge has pronounced a decision giving a big relief to the foreign workers working in the technical sector of America. It states that spouses of H-1B visa holders can work in the US.

In the process, U.S. District Judge Tanya Chutkan dismissed a lawsuit filed by Save Jobs USA that asked the court to strike down an Obama-era rule that limited the lives of certain categories of H-1B visa holders. The door of giving employment rights card to colleagues was knocked.

Tech companies like Amazon, Apple, Google and Microsoft opposed the lawsuit. The US has so far issued work rights to the spouses of about 100,000 H-1B workers, a large number of whom are Indians. In his order, Judge Chutkan noted that Save Jobs USA’s primary argument is that Congress did not authorize the Department of Homeland Security to allow foreign nationals, such as H-4 visa holders, to work in the United States.

The judge clarified the situation

The judge explained that Congress expressly and deliberately authorized the US government to make the right to employment a condition of the H-4 spouse’s permissible stay in the US. He said the reality is that the federal government has a longstanding and open obligation to authorize employment for the same visa classes. Congress has authorized the exercise of that authority. The Department of Homeland Security and its predecessors authorized employment not only for students, but also for their spouses and dependents.

Thousands of families will get relief

Immigrants’ lawyer and prominent community leader Ajay Bhuttoria welcomed the court’s decision. He said the H-1B visa program is designed to allow skilled foreign workers to come to the US and work for companies here. However, until now H-1B spouses were not allowed to work, often placing a significant financial burden on families. With this decision of the court, thousands of families across the country have breathed a sigh of relief.
