Today, only one female judge Justice Biwi Nagratna is among the 32 judges of the Supreme Court. Now the tenure of Justice BR Gawai is also seen going on the same path. The central government has approved the appointment of Bombay High Court Chief Justice Alok Arahehe and Patna High Court Chief Justice Vipul Manubhai Pancholi to appoint Justice of the Supreme Court. The notification was issued two days after the recommendation of the Supreme Court Kalizium. Union Law Minister Arjun Ram Meghwal posted on X that after consulting the Chief Justice of India, the President has asked Justice Aradhe and Justice Pancholi to be appointed as the Supreme Court judge. Now with these appointments, the number of judges in the Supreme Court will again become 34. However, there was a dispute over the appointment of Justice Pancholi. According to media reports, his name was opposed by Supreme Court Justice Biwi Nagratna at the Kalizium meeting. It is said that he cited a low rank in his All India Seniority. Also, in 2023, he was also questioned on the reasons for the transfer of Patna High Court from Gujarat High Court.
What is the objection to Justice Pancholi?
Justice Biwi Nagratna has objected to the promotion of Justice Vipul Pancholi. He says that the appointment of Justice Pancholi will be unfavorable to the Justice Administration and will endanger the credibility of the collegium system. Justice Biwi Nagaratna is the only female member of the collegium of five judges headed by Chief Justice Bhushan R. Gawai. Apart from Justice Biwi Nagratna, the collegium consists of Justice Suryakant, Justice Vikram Nath and Justice JK Maheshwari. Justice Pancholi, the center of Justice Biwi Nagaratna’s objection, has been transferred from Gujarat High Court to Patna High Court. Justice Pancholi was transferred in July 2023. Justice Nagaratna described it as a result of a deliberate deliberation. According to reports, Justice Nagaratna’s note indicates that Justice Pancholi is ranked 57th in the seniority list of Heart Court judges. Their disagreement suggests that many other senior and equally qualified judges were ignored in this process. He further stated that the Gujarat High Court is already representing Justice JB Pardiwala and NV Anjaria in the Supreme Court. According to Justice Nagratna, appointment of a third judge from the same High Court will deteriorate the balance, as many High Courts do not represent or their representation is less. Justice Nagaratna is currently in the queue of becoming the first woman Chief Justice of India. His term will start from 2027 and will be 36 days.
