Vice President Jagdeep Dhankhar said on 17 April that the courts could not order the President.
In the Delhi University program, Vice President Jagdeep Dhankhar said on Tuesday- Parliament is the highest and there can be no institution (authority) on it. The MP is the last owner in the constitution. Only elected representatives (MPs) will decide what the constitution would be like. There can be no other power on them.
Dhankhar further said- A Prime Minister imposed an emergency, he was held accountable in 1977. There should be no doubt that the constitution is for the public and it is a document to keep them safe. There is no other institution above Parliament in the Constitution.
In fact, on 17 April 5 days ago, Dhankhar had said- the courts cannot order the President. Article 142 of the Constitution has become a available nuclear missile against the special rights given by the court against democratic powers. The judges are acting like a super parliament.
This statement of Dhankhar came on the recent comment of the Supreme Court in which the court said that if the Governor sends a bill to the President, the President will have to take a decision on it in 3 months. On the criticism happening on this, Dhankhar said today- words said by a person sitting on a constitutional post, are spoken only keeping in mind the highest interest of the country.
Dhankhar asked- Why did the FIR not happen in the Justice Verma case
- Addressing the trainees of the Rajya Sabha, the Vice President said, ‘We have judges who will enact laws, who will do executive work, which will also act as’ Super Parliament’. They will not have any accountability, because the law of the country does not apply to them.
- ‘In democracy, the elected government is the most important and all institutions should work within their respective limits. No institution is above the constitution.
- Why did the FIR not have been done so far in the case of unjust cash of Justice Verma’s house? Are some people above the law? The Supreme Court has formed an in-house committee of three judges to investigate this case. It has no constitutional basis. The committee can only give recommendation, but Parliament has the right to action.
- ‘If this matter had been the house of a common man, by now police and investigative agencies would have become active. The judiciary has always been a symbol of respect, but delay in this matter, people are confused.
