Uniform Civil Code (UCC) was implemented in Uttarakhand on 27 January. CM Pushkar Singh Dhami announced this at the Chief Minister’s residence.

The Uniform Civil Code (UCC) came into force in Uttarakhand two months ago. It is also the first state to do so. But, now many of its provisions are causing practical problems before the state government. The biggest problem is that of 2.5 lakh government employees. Under the government order, it has been made mandatory for all employees to register their marriage on the UCC portal.

Employees’ organizations have come out against it. Many organizations and officers have told the government in the provisions of UCC to the government. He argues that its provisions are violating rights. There is doubt on succession decisions. These situations have come to light after the law came into force.

If sources are to be believed, the government has constituted a high power committee for this, which can report to the government in a day or two on the amendment in the provisions of UCC. In this, it can be decided to give the work of uploading the case of marriage registration, divorce-disruption on the portal.

Strike: Angry lawyers said, UCC snatches earnings

The Uttarakhand Bar Association lawyers have gone on strike against the UCC. He has threatened that if the UCC does not change, the strike will run long. President of Dehradun Bar Association Rajesh Sharma said that the UCC has ended the role of lawyers in many cases. This took away the work of advocate, notary, stamp vendor. All work including marriage registration is going online.

So far 188 applications for will change have come in the state.

Live-in: 20 registrations were done, 8 of these villages

So far, 20 couples living in live-in relationship in the state have registered themselves. Out of this, 8 pairs are from rural areas. In some cases, couples living in live-in are native to outside states. If sources are to be believed, there is a debate within the Uttarakhand government that live-in has been legalized through UCC, while it is against Indian culture.

Marriage: Employees upset with the order of re -registration

In fact, the Chief Secretary has ordered that every head of the department should upload the marriage registration portal of his employees. All DM also issued orders on this. State President of State Employees Joint Council Arun Pandey says that many DMs have also ordered to stop the salary. It seems that UCC has been imposed on us. So far 60,558 marriage registrations have been made in the state and 57 divorce applications were received.

The most problems regarding these 3 provisions of UCC law

1. Lesbian marriage: Law does not mention the registration of transgender, lesbian marriage. About 10 such cases came up in two months, but could not be registered. After marrying a foreign national, the Aadhaar card mandatory in marriage registration is becoming an obstacle. In Uttarakhand, women of Nepal are also getting married to a large number of local youth.

2. Live-in: It is mandatory to inform the police with live-in couples as per UCC rules. Due to this, their privacy is being violated. If someone was a minor at the time of marriage, but has now become an adult, then there is no rule regarding it in UCC.

3. Caste marriage: If the Scheduled Tribe is married with general caste, then there is a problem in registration. What is the decision to be taken in the event of marriage of Scheduled Tribes of other states with Scheduled Tribes of Uttarakhand. There are many contradictions among the registration officers regarding this.
