The Supreme Court has agreed to hear the petition of the producer of ‘Udaipur Files’ against the Delhi High Court order to stay the film. The Supreme Court agreed to hear the appeal on Monday, which challenged the Delhi High Court’s order banning the release of the film “Udaipur Files: Kanhaiya Lal Tailor Murder” based on crime by alleged Islamic fundamentalists in the city of Rajasthan. Senior advocate Gaurav Bhatia, appearing on behalf of the film’s makers, mentioned the appeal against the Delhi High Court’s order before the bench of Justice Suryakant and Justice Joymalya Bagchi and demanded immediate hearing. The High Court order came on July 10, the day before the scheduled release on 11 July. Bhatia said that the Central Board of Film Certification (CBFC) has approved the “Udaipur files” for release and theaters have been booked. “I had a certificate. All theaters were booked …”.
Justice Suryakant and Justice J.K. Bagchi’s bench said that the lawyer appearing on behalf of the makers requested an immediate hearing on the petition, saying that the release of the film has been banned despite the Certification of the Central Board of Film Certification (CBFC). The bench said that it would hear it on Wednesday or after any day. The lawyer argued that the apex court had refused an immediate hearing on the petition requested to stay the film’s release.
However, the High Court intervened in this regard and immediately stayed the release of the film on 10 July. The lawyer argued, “We have spent money on the film and received CBFC certification, but despite this the High Court stayed its release.” This is a violation of our rights. ”He requested an immediate hearing on the petition on Tuesday.
The bench said that it would hear the petition on Wednesday or after any day. The Delhi High Court on July 10 banned the release of ‘Udaipur Files’ until the Center decides on petitions requesting a permanent ban on the film. The petition states that the film can “promote disharmony” in society, so its release should be banned.
The High Court had directed the petitioners to contact the Center within two days with their complaint. It also said that he did not try to contact the central government. Petitions filed in the High Court by Maulana Arshad Madani, president of Jamiat Ulema-e-Hind, claimed that the trailer of the film released on 26 June has been filled with dialogues and incidents that led to communal tension in 2022 and feared that the same feelings may be disturbed again from the release of the film.

The producer of the film argued in the High Court that “it is based on the background of India-Pakistan.” The petitioner has taken the dialogues out of the context. “The High Court on July 9 directed the manufacturers to arrange the film’s ‘screening’ for the petitioners. Kanhaiya Lal, a tailor from Udaipur, was allegedly murdered by Mohammad Riyaz and Mohammad Gaus in June 2022.

The attackers later released a video that claimed that he was murdered in response to a post allegedly shared on the social media account of tailor Kanhaiya Lal Sharma in support of former BJP (Bharatiya Janata Party) leader Nupur Sharma’s Prophet Mohammed.
The case was investigated by the National Investigation Agency (NIA) and the accused were registered under the Prevention of Rigid Unlawful Activities Act (UAPA) besides the sections of the Indian Penal Code. The case is pending in the special NIA court of Jaipur.
The apex court on July 9 refused to list the petition challenging the release of ‘Udaipur files’ on July 9 and said orally, “Let the film be released”. The petition was filed by Mohammad Javed in the apex court, who is facing trial as the eighth accused in the case. Javed had requested to stop the film’s release until the hearing of the case was completed.
