Making an important comment on marriage and dependence, the Supreme Court stressed that it is impossible to claim complete freedom for the spouse during marriage. A bench of Justice BV Nagratna and Justice R. Mahadevan warned that those who are not ready to depend on each other should not be tied in marriage. Justice Nagratna said during the proceedings that marriage means the meeting of two souls, two persons. No husband or wife can say that I want to be completely independent of my spouse.

These comments came during the hearing of a dispute related to a separate couple and their two minor children. The husband, who works in Singapore, is currently in India, while the wife lives in Hyderabad. The bench expressed concern for the children, if they come together, we will be happy because the children are very young. What is their fault that they have to face a broken house? The wife appeared through the video conference argued that her husband is only interested in custody and meeting, not in reconciliation. He also claimed that he had not received any alimony, which made her life difficult as a lonely mother.

The bench asked the wife why she could not return to Singapore, where she and her husband’s “best jobs”. She replied that her husband’s previous work has almost become impossible for her. He also emphasized the need to work for his livelihood. When the wife insisted that she does not want to depend on anyone, Justice Nagratna said in the middle, “You cannot say so. Once you get married, you become an emotionally dependent dependent on your spouse. If you did not want to depend on anyone, then why did you get married?”
