The US Supreme Court on Friday banned Trump’s decision to remove the people of Venezuela from the country. The Trump administration wanted to send people out of the country at the earliest at a detention center in Texas through the ‘Alien Animes Act’ of 1798.

The Alien Animes Act is a law made of the time of war in which the enemies did not have to take too much legal action to get the enemies out of the country. Stanning the decision of the Trump administration, the court said that the government would have to give them full opportunity for the legal process before taking out the people from the country.

The court also said that the way the Trump administration adopted, such as sending a immigrant out of the country without hearing in 24 hours, it is not right from anywhere.

The lower court denied hearing, now the same decision will be given

This decision means that migrants have the right to know and challenge the court as to why they are being evacuated. However, this decision is still temporary and the entire legal battle on it is still pending.

The Supreme Court has sent the case back to a lower court (Fifth Circuit Court) so that it can be heard well there. This was the same by the court who refused to intervene in the case in April.

Trump administration sent 137 people to Al Salvador

Trump has been trying to evacuate people living illegally in the country since the second time coming to power. The Trump administration, using the Alien Animes Act, sent about 137 immigrants in Venezuela to Al Salvador in March 2025. Court stops Trump’s decision earlier

The US Supreme Court had laid a temporary ban on using the Alien Animes Act of the Trump administration at the end of March. The court said that not a single immigrant should be sent out through this act until he listens to this matter completely.

Now after a complete hearing on 16 May, the Supreme Court has further extended this temporary stay, and has left the case on the lower court. This means that the Trump administration still cannot send anyone out.

  • If this is legal then how much legal process (eg notice, opportunity to appeal) should be received by the migrants?

The court has not made it clear that what will happen to 137 people sent to Al-Salvador now? At the same time, families of deported persons say that they have not got any information about their people. They are worried about their family.

Lee Galerrant, a lawyer of ACLU, who is fighting the case on behalf of these people, said that the court’s decision is like a rebuke for the Trump government.
