The Allahabad High Court refused to ban the survey of Jama Masjid in Sambhal, UP. The court rejected the Civil Revision petition of the Masjid Committee, demanding a stay on the survey. Justice Rohit Ranjan Aggarwal’s bench gave this order on Monday

The court said- whatever action has been taken in this case so far is correct. We will not interfere in the court commissioner survey. The cases filed by the Hindu side are listened to. Court commission survey and filing suit will continue as before. That is, there is Jama Masjid or the temple will also continue to be prosecuted in Sambhal’s Lower Court (Civil Court).
Following the High Court order, the police conducted a flag march in Sambhal city on Monday evening. SP Krishna Kumar Bishnoi said- Keeping in mind the decision of the court, the Sambhal police are being patrolled on foot. Cyber space is also being monitored.
He said-
I appeal to all that do not make any such comment that raises questions on the dignity of the court and also do not comment on any other community. No vulgar remarks should be made. No fight will be fought on the road, if anyone does this, action will be taken against him.
In fact, on the petition of the Hindu side, the Sambhal court ordered the Advocate Commissioner Survey of Jama Masjid on 19 November 2024. The same evening the team reached for the survey. The survey could not be completed due to night.
After 5 days, i.e. on November 24, the Advocate Commissioner and ASI team reached for the re -survey. Violence erupted during this period. 4 people died in this.
Violence took place during the Jama Masjid survey of Sambhal on 24 November.
Understand what happened till now … After the violence, the arrangement of the mosque, while filing a petition in the Supreme Court, demanded a stay on the survey. The Supreme Court ordered the Allahabad High Court to hear the case. By then the Supreme Court had stopped the Sambhal court from taking further action in the case.
On 8 January 2025, the High Court, while giving an interim order, stayed the survey of the mosque. Also sought answers from all the parties including the arrangement. After this the hearing started. After the debate was completed on May 13, the High Court reserved its decision.
The High Court now refused to stay the survey. Also, said that the lawsuit will continue. According to the expert, the High Court has accepted the Sambhal Court’s survey decision as correct. Also, ordered action there.
What will happen next?
- The Masjid Committee can visit the Supreme Court after the revision petition is dismissed from the High Court. A review can file a petition in the High Court, so that the survey can be stopped.
- The Hindu side will try to start the survey soon. Will present in court for the right to worship. Efforts will be made to come from the lower court as soon as possible.

Claim of Hindu side- Sambhal is not a mosque, Harihar temple Regarding the Jama Masjid of Sambhal, the Hindu side claims that it was earlier the Harihar temple, which Babur broke in 1529 and built a mosque. A petition was filed in Sambhal Court on November 19, 2024. This petition was filed by Mahant Rishi Raj Giri Maharaj of Kailadevi Temple located in Sambhal. On the same day i.e. November 19, Civil Judge Senior Division Aditya Singh ordered a survey inside the mosque.
The court appointed Ramesh Singh Raghav as Advocate Commissioner. On the same day, the team reached the mosque for the survey at 4 pm. Surveyed 2 hours. However, the survey was not completed that day. After this, the survey team reached Jama Masjid on 24 November. Survey was being done inside the mosque. Meanwhile, a large number of people gathered. The mob threw stones at the police team. After this violence erupted. In this, 4 people died after being shot.
All India Shia Personal Law Board said- no longer fight for the temple-mosque All India Shia Personal Law Board General Secretary Maulana Yasub Abbas said on the decision given on the survey of Sambhal Jama Masjid of the court- We respect the court’s decision. We trust our judicial system. It will definitely be said that the court should see that whoever is coming, they should not come as representatives of any party. Because people’s faith in the name of temple and mosque also breaks and is also formed. Many people have been killed, so no longer fight in the name of temple-mosque. If there is a fight, it should be for development, unemployment and illiteracy.
Survey report was filed on January 2, 2025 A 45 -page survey report of Jama Masjid in Sambhal was filed in Chandausi Court on 2 January 2025. 4.5 hours of videography and more than 1200 photos were also given to the court. It claimed that evidence of the temple in Jama Masjid has been found.
More than 50 flowers, scars and artifacts have been found in the mosque. There are 2 vat trees inside. Vat tree is worshiped in Hinduism. There is a well, half of it is inside the mosque and half is out. The outstanding part is covered.
