SC said- Crime occurred due to caste system, which was called Honor Killing.
The Supreme Court said on Monday- Strict punishment should be given for honor killing. The court said this while upheld the sentence of 11 convicts in the murder of a 2003 couple in Tamil Nadu.
The court told about the incident- the victims Murugsan and Kannagi were killed by poisoning the people of the village. The mastermind of this disgusting crime was the father and brother of the woman. Kannagi was from the ‘Vanniyar’ community, while Murugsan was a Dalit. In May 2003, both of them got married hiding. For this reason, he was murdered.
A bench of Justice Sudhanshu Dhulia and Justice Prashant Kumar Mishra said- This crime occurred due to deep caste system in India. Ironically, this shameful murder is called ‘Honor Killing’. At the same time, the Madras High Court refused to intervene on the June 2022 decision, in which the sentence of the accused was upheld.
In 2003, Murugson and Kannagi were killed by poisoning the people of the village.
Police officer involved in crime, 5 lakh compensation to victim The Supreme Court said- Two police officers intentionally did not register an FIR in the case and tried to save the criminals. For this reason, he has been convicted under Section 217 of the Indian Penal Code and the Scheduled Castes/Scheduled Tribes (Prevention of Atrocities) Act 1989. One of them was reduced to two years, while the life of the other has been retained.
The court ordered an additional compensation of Rs 5 lakh to Murugson’s family, which will be different from the earlier compensation. This amount will have to be given to the Tamil Nadu government.
Trial completed after 18 years The Supreme Court said the incident was in 2003, but the case ended in September 2021. Murugesan’s family moved to the High Court, after which the investigation was handed over to the CBI in April 2004. It is unfortunate but truth that it took 18 years to come to the trial court’s decision in this case.
The court said- Delay in trial has become common in criminal justice system in India. For this reason, the witnesses start retracted. Nevertheless, it is the duty of the court to give a fair decision on the available evidence. Also ordered that the accused who are on bail should surrender within two weeks and complete the remaining sentence.
A total of 15 people were prosecuted in the murder case, of which 13 were found guilty. Of these, 11 were convicted of murder. One of the accused was sentenced to death by the trial court, which was converted to life imprisonment by the High Court.
