A bench of Justice Abhay S. Oka and Justice Ujjal Bhuiyan clarified that no person can cut the tree without permission from the concerned officer or institute.
The Supreme Court on Tuesday said that cutting a large number of trees is worse than the killing of a human being. No pity should be shown on those who damage the environment.
The SC has approved a fine of one lakh rupees for each tree illegally deducted. Also dismissed the petition against the fine.
A bench of Justice Abhay S. Oka and Justice Ujjal Bhuiyan clarified that no person can cut the tree without permission from the concerned officer or institute.
In fact, SC was hearing a petition, in which a person demanded a fine and not taking action for imposing fines on cutting trees.
Laws and trees cannot be taken lightly
The bench accepted the suggestion of Senior Advocate ADN Rao that the criminals should be given a clear message that laws and trees cannot be taken lightly nor taken. The court, in its order, has also decided a benchmark of how much penalty should be imposed in such cases.
1 lakh rupees per tree for cutting 454 trees
The court has accepted the report of the Central Empowered Committee (CEC), in which Shiv Shankar Aggarwal fined Rs 1 lakh (total-4.54 crore) per tree for 454 trees cut last year. Senior Advocate Mukul Rohatgi, who is fighting Aggarwal’s case, told the bench that his client had accepted the mistake and apologized.
At the same time, the court has requested to reduce the fine amount, which he has told a lot. Mukul also said that Aggarwal should be allowed to plant saplings not on that land but also at any nearby place. The court refused to reduce the fine amount. Permission to plant saplings in nearby areas.
