Ruckus over the investigation of voter list in Bihar, Supreme Court reached Mahua Moitra

West Bengal MP Mahua Moitra has filed a petition in the Supreme Court against the order of the Election Commission for special investigation into the voter list (voter list) in Bihar. He says that this order is wrong and it can take away many people’s right to vote.

What is the order of Election Commission?

The Election Commission issued an order on June 24, 2025, stating that there would be a thorough investigation of the voter list in Bihar. This means that people whose names are already in the voter list and who have voted many times, will also have to show new documents to prove their citizenship. These documents also include evidence of parents’ citizenship. If they are unable to do this, then their name can be removed from the voter list.

Mahua Moitra’s concerns

The petition by Mahua Moitra stated that this order violates the provisions of Article 14, 19 (1) (A), 21, 325, 326 and the Representation of the Constitution of India, 1950 and the Election Registration (RER) Rules, 1960. Their main concerns are:
Snatch the right to vote: The petition says that by this order, a large number of people in the country will not be able to vote, who are actually entitled to vote. This will affect our democracy and fair elections.
Penning conditions: This is the first time that the Election Commission has asked voters to prove their eligibility, whose names are already in the list and who have voted before.
Do not accept Aadhaar and Ration Card: In this order, common identity cards like Aadhaar card and ration card have not been recognized. This is putting a lot of burden on the voters and it is difficult for them to collect the necessary documents.
Effect on the poor: The petition also states that this order will affect people especially the poor and weaker sections. It has been compared to the National Register of Citizens (NRC), which has been criticized a lot earlier.
Hurry: The order states that if new forms are not submitted by July 25, 2025, the name will be removed from the draft list. The petition states that it is also wrong to give so much time.

Will other states also have an impact?

It has also been demanded in the petition that the Election Commission should be prevented from issuing similar orders in other states of the country. Mahua Moitra has received information that from August 2025, there is a preparation to start a similar investigation in West Bengal. This petition has been filed by lawyer Neha Rathi.
