Marriages taking place in shops of Mansa Devi complex, use of same Jaimala, HC seeks reply from Haryana

The Punjab-Haryana High Court has ordered the Haryana government to submit a report about the shops where marriages are being conducted in the Mansa Devi complex of Panchkula. Neither the correct information about the couple nor the jurisdiction is taken into account while conducting the marriage. The same Jaymala is being used in every marriage, the customs are not being taken care of. The Fazilka SSP has also been ordered to ensure security of the couple till the next hearing.

A petition was filed in the High Court by Fazilka's love couple, in which they sought protection from their parents citing the threat to their lives. The couple had decided to get married in a temple in Panchkula. When the High Court asked for information about the Pandit who conducted their marriage, they could not tell anything.

On this, the High Court said that marriage is not just a contract between two persons, but a sacred relationship and in such a situation, customs cannot be ignored. It is not only related to ethics, but due to its misuse, the social fabric is also being damaged. The petitioners also did not know whether the persons performing the marriage ceremony were authorized under the provisions of Sections 5 and 7 of the Hindu Marriage Act, 1955 or not.

The High Court said that as the guardian of the Constitution under Article 226 of the Constitution, the court has a duty to ensure the life and liberty of not only the petitioners but also their family members. Parents also have the right to live with dignity.

The High Court ordered the SP of Fazilka to be posted on the duty of a head constable till the next date to ensure that the life and liberty of the petitioners are not harmed. The petitioners will have to bear the expenses of the police officer, which will include the DA as well as the full day's meals.
