The Union Law Minister had said in Parliament that the responsibility of implementing the court orders is on the concerned administrative ministries and departments.
The Union Law Ministry has issued instructions to other ministry. In this, the court has been asked to respond on time in the pending cases of contempt. So that contempt actions can be prevented. There are pending cases of about 1.50 lakh contempt (disregard) associated with the central government in courts across the country.
The ministry said- Many officials who handle the case in the ministry and their departments do not have qualification in the field of law. This delays lack of legal understanding and responding to judicial instructions. This is the reason why cases are registered against the heads of departments.
In fact, during the budget session, Union Law Minister Arjun Ram Meghwal had filed a written reply during the budget session. It said that the responsibility of implementing the court orders is on the concerned ministry and departments.
Ministry’s instructions
- The ministry directed that all ministry should appoint a nodal officer. These officers should not be below the rank of joint secretary. He should be entrusted with the responsibility of management of the case.
- The nodal officer should have LLB degree. Apart from this, there should be high education and it should also be a judicial expert.
- The posts of Director (Law), Deputy Secretary (Law)/ Additional Secretary (Law) should be generated to deal with the legal case in the ministry.
No legal cell in most ministries
The instructions of the Law Ministry said that due to lack of resources, the ability to handle the case in ministry is limited. Most ministry and department do not have legal cells. Cases handle the administration or technical division.
The ministry said that contempt proceedings are initiated against government officials for sometimes not following judicial decisions and orders. It can be prevented by making better monitoring and management systems.
Meghwal had said- 5 crore cases will be settled soon
Union Law Minister Arjun Ram Meghwal said in January 2025 that more than 5 crore cases are pending in the country’s courts. The ‘Alternative Dispute Regulation Mekanism’ (ADR) system has been prepared for their disposal. In this system, options like arbitration, mediation and Lok Adalat will be used.
He had said that from 1 July 2024, the Indian Judicial Code (in place of IPC), the Indian Civil Protection Code (in place of CRPC) and the Indian Evidence Act (Indian EVIDENCE Act three new laws would apply.…………………..
