The Supreme Court has made very strict remarks in the case of ethnic favoritism from judges in the judiciary. The court said- This judge fell victim to the situation and caste partiality. Everything was already fixed. People from the upper community were unable to tolerate that the boy (cobbler) of the neglected community became a judge at a young age and came between them.

Justice Suryakant was hearing in the open court on Monday in the case of the dismissal of the Additional Sessions Judge (Prem Kumar) of Punjab. He said- The dismissal of the judge was wrong, they should be restored. Also, promotion and all other benefits of his service should be given.

Judge Prem Kumar was dismissed convicted of ‘suspected loyalty’ on the complaint of the accused in the rape case.

Know what was the whole matter …

In fact, Prem Kumar of Barnala became Additional District and Sessions Judges on 26 April 2014 and was appointed in Amritsar District Court. During this time, the accused of rape complained in the High Court that Prem Kumar approached the rape victim for an agreement and got Rs 1.50 lakh to the victim. The High Court started the vigilance investigation.

Based on this, ‘honesty suspicious’ was recorded in the annual confidential report of the judge. Then in 2022, the full bench of the Punjab and Haryana High Court dismissed Prem Kumar on the basis of this 2015 report and complaint.

Prem Kumar challenged his dismissal in the Punjab and Haryana High Court. In January 2025, his dismissal was canceled citing lack of evidence. The High Court challenged the decision in the Supreme Court.

If the loyalty of a judge is considered suspicious, it means that there is a signal found in his decision, behavior or personal contacts that question the judicial fairness.
