The hearing in the Supreme Court on the Supreme Court on a petition of the transfer of life imprisonment in the former Punjab Chief Minister Beant Singh murder case from Tihar Jail (Delhi) in Punjab jail (Delhi) was again postponed in the Supreme Court. Justice BR Gawai -led bench on Monday

During the hearing on 4 February 2025, the Punjab government strongly opposed Hawara’s petition, saying that it could be shifted only to Chandigarh, not Punjab, as its trial process was done in Chandigarh. Punjab Advocate General told the court that Hawara had earlier filed a similar petition in the Delhi High Court in 2018, which was rejected.

The court has sought answers from the Central Government, Delhi Government and the Chandigarh administration on Hawara’s petition. Hawara has argued that:

  • There is no pending case in Delhi.
  • He is unable to attend an old case hearing in Punjab as he is not being produced from Delhi.
  • His 14 -year -old daughter lives in Punjab, but he is unable to contact due to being in jail.
  • His conduct in jail has been good, and the Punjab Jail Director recommended his transfer in 2016 itself.

Hawara’s lawyer senior advocate Colin Gonsalves said in the last hearing that Hawara was not getting the right to meet his daughter, while all other co-accused are in Punjab jails. He also claimed that he was acquitted in 35 of the 36 cases registered against Hawara, and only one case is pending.
