In September 2021, the High Court stayed the proceedings of a criminal complaint filed by the Drug Control Department of Delhi in the Rohini court against the Gautam Gambhir Foundation. The complaint filed under the Drugs and Cosmetics Act was accused of unauthorized storage and distribution of Kovid medicine during a medical camp organized by the Foundation during the second wave of epidemic in Delhi.

In the complaint, GGF trustee then BJP MP Gautam Gambhir, his wife Natasha Gambhir, his mother Seema Gambhir and CEO Aparajita Singh were also accused. The Drug Control Department had alleged that GGF did not have a license for storage or distribution of medicines including medical oxygen. This violated the provisions of the Drugs and Cosmetics Act 1940 and the rules.

At the same time, the lawyer of the accused demanded a stay this year. In an order on 9 April, Justice Neena Bansal Krishna lifted the interim ban and listed the case before the High Court on 26 November for further debate. On Monday, the Foundation and its trustees advocate Jai Anant Dehdrai said that the next date before the trial court is now September 8. He requested that the accused be given protection until the High Court is the next hearing of the case in November.
