An FIR has been lodged on Wednesday night after the High Court’s order regarding the controversial statement on Colonel Sophia Qureshi.
Following the order of Madhya Pradesh High Court, the police finally registered an FIR against Madhya Pradesh Minister Vijay Shah at around 11 pm on Wednesday night. The Madhya Pradesh High Court took automatic cognizance of his statement. A bench of Justice Atul Sreedharan of Jabalpur High Court and Justice Anuradha Shukla had given instructions to the DGP to the FIR on the date itself. Following the High Court order, a crime has been registered against Vijay Shah under sections 152, 196 (1) (b) and 197 (1) (C).
The High Court said-
Register a crime of endangering India’s unity integrity. If the FIR is not lodged, the DGP will be prone to contempt of court. Minister Vijay Shah’s statement is going to increase communalism.
The minister attended an event in Raikunda village of Mhow, Indore on Sunday. It was here that a controversial statement was given. However, the video went viral on Tuesday. She had described Colonel Sofia Qureshi as the sister of the terrorists. The High Court said this regarding the statement of Minister Vijay Shah
- The High Court found that prima facie the Code of Justice of India proves to be crime against the minister under the 2023 (BNS).
- A crime is formed under Section 152 of the Indian Code, which declares the acts that endanger the sovereignty, unity and integrity of India as a crime.
- Section 192 of BNS also creates prima facie crime, which is related to spreading disharmony between various communities on the basis of religion, caste, place of birth, residence, language or caste.
The High Court said that insulting Colonel Sophia Qureshi, who believes in Islam religion, attracts the above streams. On the basis of observation, this court directs the Director General of Police of Madhya Pradesh to file an immediate FIR against Minister Vijay Shah under Section 152, 196 (1) (B) and 197 (1) (C).
The court said that this work must be done by this evening, otherwise when the case is listed tomorrow, the court can consider taking action against the Director General of Police of the State for contempt of this order. The court said- it should be ensured that this is done. List the case at the top of the 15 May 2025 list.
