Delhi Court strict order, FIR in death of 5 -year -old auto driver, police reprimanded

Nearly five years after the suspected death of 23 -year -old auto driver Vivek Kumar, a Delhi court has ordered an FIR to be filed and reprimanded the police for not taking action first. This instruction has come on the petition of the victim’s father Rameshwar Dayal, who had approached the court even after repeated complaints from the New Ashok Nagar police.

Dayal was represented by advocate Amresh Anand. Vivek Kumar was last seen on November 1, 2020 after his auto-rickshaw owner Anil. His body was later recovered from the sewer treatment plant of Delhi Jal Board at Kondli, and the postmortem report stated to suffocate due to his death. Despite the scuffle with the deceased in the CCTV footage, the police did not register a case and said that there was no disturbance in it.

Additional Chief Metropolitan Magistrate Mayank Goyal cited the Supreme Court’s decision in Lalita Kumari vs. Uttar Pradesh Government (2014), saying the facts clearly reveal the cognizable offense of murder. The court said the investigating officers lodged a report with the “predetermined perception” and ignored the complainant’s evidence. In his order, the judge directed not only the concerned SHO to register an FIR without delay, but also instructed all ACPs and SHOs to be made aware to register FIRs immediately in matters related to human damage.
