Big decision on celebrity rights! The High Court of Aishwarya Rai’s ‘Personality Rights’ protects, name and image will not be misused now

The Delhi High Court has given protection to Bollywood actress Aishwarya Rai Bachchan on her personality rights, saying that her name, image, voice, or unauthorized business use of other characteristics would be a violation of her right to live.Justice Tejas Karia prevented several institutions from misusing the actress’s personal characteristics, including her picture and identity mark, from misusing for commercial advantage without her consent. The court said that such misuse not only causes financial loss, but also hurts their dignity and prestige.

 

High Court protected Aishwarya Rai’s personality rights

The order stated, “Any violation of the plaintiff’s personality rights will create confusion among the public not only about the support or sponsor of any product or service, but also reduce the reputation and credibility of the plaintiff.”

The court said that Aishwarya Rai Bachchan is one of the most famous personalities in the Indian entertainment world and has been the brand ambassador of many companies. Justice Karia said, “He has earned such a good credibility and reputation that the public trusts the brands supported by him.”
This decision strengthens security against unauthorized exploitation of advertisements, business goods and digital media, and emphasizes that personality rights are closely associated with the fundamental right to life and respect of a person under Article 21 of the Constitution.

What are personality rights?

According to Siril Amarchand Mangaldas, TMT’s Digital+ partner and co-head Mihir Rale, “Indian Courts have consistently recognized personality and publicity rights under Article 21 of the Constitution, which are implemented through general legal admissions, such as the misuse of passing of and goodwill.”
Rale further stated, “The roots of the right to obtained the right to privacy of the generally obtained the rights of the Digital Personal Data Protection Act, 2023 in the famous Justice Puttaswamy case are also found. This right can be even more relevant in the era of AI and Deepfac. This right may be even more relevant. Is.” 
 
Advocate Nipun Saxena, who is working in the Supreme Court of India, said that these rights fall under the Copyright Act, which claims their voice, image, body and face ownership and ownership on their voice, image, body and face. Saxena said, “In simple words, this means that celebrities legally control how their name, image and identity are used, and they can take action against any unauthorized business exploitation.”
