The petition filed by Sultana Shaheen, owner of the properties at Batla House and a petition filed by 39 others stated that on May 27, 15 days eviction/demolition notice was pasted on their properties.
The Supreme Court on Thursday agreed to hear the petition filed against the demolition notice of the properties at Batla House in Jamia Nagar here next week. The holiday bench of India’s Chief Justice BR Gavai and Justice Augustine George Christ agreed to post the case next week after the lawyer mentioned the early hearing of the case. The petition filed by Sultana Shaheen, owner of the properties at Batla House and a petition filed by 39 others stated that on May 27, 15 days eviction/demolition notice was pasted on their properties. The petition filed through advocate Adil Ahmed states that it was done after the May 7 Supreme Court order, in which the Delhi Government and the Delhi Development Authority (DDA) were directed to demolish illegal properties in the Batla House area.
He said that the action is wrong because he was never made a side in that case and he was not given an opportunity to present his case. They are the real residents and property owners of Khasra Number 271 and 279, Batla House, who now received 15 days eviction/demolition notice on May 27, 2025 as per the court order on May 7, 2025, while they have not been made a party or given an opportunity to hear.
The petition stated that any comprehensive demolition campaign launched without giving adequate and meaningful opportunities to the affected residents would be a severe violation of the principles of natural justice and the direct violation of the fundamental rights contained under Article 14, 19 (1) (E) and 21 of the Constitution. The petition further stated that “Group of affected residents, whose houses come to this area, are now demanding to demolish on the alleged grounds of being out of the PM-ease.
