The Bombay High Court has ordered an FIR on five policemen in the encounter case of the accused in the Badlapur sexual abuse case. To investigate the case, a special investigation team (SIT) has also been ordered. For this, the court has given two days time.
The court criticized the state government on Monday for not registering an FIR for the encounter. The court said- This weakens confidence in the common man’s criminal justice system.
The state government had argued that only the policemen cannot register an FIR on the basis of the magistrate’s investigation, we are waiting for the report of CID.
The magistrate investigation of the encounter raised doubts over the claims of firing in the self -defense of the policemen. In the report, five policemen were held responsible for the death of the accused.
A bench of Justice Revathi Mohite Dera and Justice Neela Gokhale said that even though the parents of the deceased do not want to pursue the matter, the court cannot see everything by keeping silent.
Anna Shinde, father of accused Akshay Shinde, had filed an appeal in the High Court that his son was murdered in a fake encounter. However, he later withdrew the petition.
Court said- not just justice, it is also necessary to see justice The bench has ordered the setting up of SIT under the leadership of Joint Police Commissioner Lakhmi Gautam of Mumbai Crime Branch. Gautam will be allowed to choose the officers of his choice in SIT. The court has asked CID to hand over all the documents related to the case to SIT within two days.
The court said that the magistrate’s report needs a thorough investigation into the encounter. It is the duty of the police to follow the law. Justice should be done not only, but also to be seen as justice. We hope and believe that SIT will find out the conspiracy.
