The Allahabad High Court has expressed displeasure over the behavior of a guinea pig or ATM machine with patients and dismissed the petition of a doctor against the criminal action initiated against them in the death of a pregnant woman. Justice Prashant Kumar said that nowadays it has become common for treatment of patients for treatment despite insufficient doctors or infrastructure in nursing homes and hospitals. The court said that medical facilities have started using them as a guinea pig/ATM machine to make money from patients.

Therefore, the court dismissed the petition of Dr. Ashok Kumar Rai, the owner of the nursing home, who admitted a pregnant woman for delivery and surgery, while the anesthetist arrived late at the nursing home and the fetus died. The doctor challenged the ongoing criminal proceedings against him in this case. The court dismissed the petition that medical professionals should get protection, but not those who are running without proper facilities, infrastructure or doctors’ nursing homes and only looting patients.

After seeing the records, the court found that the current case was completely of an accident, where the doctor admitted the patient and did not conduct timely operation due to the non -availability of the anesthetist even after taking permission from the family members. The court found that it is not a case of the doctor being disqualified, but whether he had taken proper care or negligence in providing treatment on time.
