The Supreme Court overturned the interim order of the Madras High Court in which the Tamil Nadu government was banned from the name of Stalin with you and the use of photographs of former Chief Ministers in public planned publicity materials. The court said that such practices are common all over India and warned against using the judiciary for political gains. A bench headed by Chief Justice BR Gavai of India and Vinod Chandran of Justice, who filed the original petition, filled the AIADMK MP CV Shanmugam only to selectively challenge the promotional content of the government headed by the DMK.

Senior advocate Mukul Rohatgi, appearing for Tamil Nadu, clarified that ‘Stalin with You’ is not an independent welfare scheme, but a digital interface that allows citizens to use several government services on the same platform.

He also stated that there is no legal restriction on naming any platform or scheme after political leaders, nor any decision of the Supreme Court prohibits the use of their photographs. The court agreed with the argument of the Tamil Nadu government that many state governments use the names and photographs of political personalities in advertisements of government schemes.
