How did the whole matter come up? A woman from Maharashtra was divorced in 2022. The woman also had two children. The woman then remarried to a young man living in Rajkot. Meanwhile, the woman went to her sister’s house in Maharashtra on 27 April 2025 with her daughter. Here his 13 -year -old daughter complained of stomach ache and was taken to a government hospital. Medical examination revealed that the girl was pregnant for 20 to 22 months.

After this, the matter reached the police and the woman police counselor took the girl in confidence and knew the whole truth from her. The girl told him that her cousin Sahil (name changed) and her friend raped her several times in Rajkot. Then the girl’s mother lodged a complaint against Sahil and her friend who was accused.

Both are in a minor reform home on the court’s order. The police have sent both the minor accused and the DNA of the fetus in the stomach of the victim for testing.

The lower court rejected the petition After the rape case was registered, the biggest concern for the girl and her family was about the fetus in the stomach. On May 2, the minor accused were arrested. The next day i.e. on 3 May, the girl’s family filed a petition for abortion in the lower court of Rajkot. When the lower court asked for a medical report, it was found that the minor was now pregnant for 31 weeks and 6 days. The court dismissed a petition seeking permission for abortion on 6 May.

What does abortion law say? Under the Medical Termination of Pregnancy (MTP) Act, any married woman, rape victim, disabled woman and minor girl are allowed for up to 24 weeks. If the pregnancy is more than 24 weeks, then permission has to be obtained from the court on the advice of the Medical Board for abortion. The MTP Act was changed in the year 2020.
