Rahul Gandhi’s citizenship has been challenged by BJP leader Vignesh Shishir in the High Court.
The petition challenging the dual citizenship of Congress MP Rahul Gandhi was heard in the Lucknow bench of Allahabad High Court on Monday.
The High Court asked the Central Government- ‘Rahul Gandhi is a British citizen or not, respond in 10 days. The central government presented a status report during the hearing of the petition of BJP worker Vignesh Shishir.
The court considered it inadequate and directed the government to give more clear answers. The court said that the matter is of national importance and the delay in it will not be acceptable.
The central government sought additional time to answer this. Additional Solicitor General (ASG) Suryabhan Pandey said, no lawyer appeared in court on behalf of Rahul. The High Court has asked that the Center should clear whether Rahul Gandhi is an Indian citizen or the British. The next hearing will be held on 5 May.

Earlier, the Lucknow High Court had a hearing on 24 March. A division bench of Justice AR Masudi and Justice Ajay Kumar Srivastava directed the state government to file a status report in four weeks. The government had sought 8 weeks. The date of hearing on this April 21 was fixed on this.
At the same time, on December 19, 2024, a bench of Justice Rajan Roy and Justice Om Prakash Shukla directed Additional Solicitor General (ASG) Suryabhan Pandey to get information from the Union Home Ministry.

What is the case of Rahul Gandhi’s citizenship? On July 1, 2024, a petition was filed by Karnataka’s lawyer and BJP leader S Vignesh Shishir in the Allahabad High Court. In this, he also accused Rahul Gandhi of having British citizenship. The petitioner accused the British government citing the confidential mail of 2022. Vignesh Shishir had demanded Rahul Gandhi’s cancellation of Indian citizenship under Section 9 (2) of the Indian Citizenship Act 1955.

The petitioner has documents of British government The petition requested Rahul to cancel his election from Rae Bareli Lok Sabha seat this year due to alleged hiding British citizenship. The petitioner has argued that he has all the documents and some emails of the British government that prove that Rahul Gandhi is a British citizen and because of this he is ineligible to contest elections in India. Therefore, he cannot handle the post of Lok Sabha member.

Question 1: What will happen if Rahul proves allegations of dual citizenship? If Rahul Gandhi is found guilty in dual citizenship case, he will be taken action under Article 9 (2) of the Indian Constitution. A case of hiding his citizenship and giving wrong information on Rahul Gandhi will go on.
Under the Citizenship Act 1955, Rahul can be sentenced to 5 years for violating legal provisions. Rahul can be imposed a fine of Rs 50,000 or punishment and fine. Apart from this, his Indian citizenship will also end automatically.

A similar petition was dismissed in the Supreme Court in 2019 In 2019, the Supreme Court dismissed Rahul’s petition related to Indian citizenship. The then Chief Justice Ranjan Gogoi had said that if a company mandates Rahul Gandhi as a British citizen in a form, did he become a British citizen only by doing so.
A bench of CJI Gogoi, Justice Deepak Gupta and Justice Sanjeev Khanna had said- ‘We dismiss this petition. There is no basis in this. “The petition stated,” The court should direct the Ministry of Home Affairs to take a decision on Rahul’s citizenship. “
The petition also demanded that Rahul Gandhi be disqualified from contesting elections. Petitioner Jai Bhagwan Goyal mentioned the UK company’s annual details of 2005-06. In this, Rahul was reportedly described as a British citizen.
