Rajya Sabha MP Kapil Sibal on Friday objected to the statement of Vice President Jagdeep Dhankhar’s ‘Judge Do not advise the President’. Sibal said, ‘The President is a nominal head in India. The President and the Governor have to work on the advice of governments. I am surprised to hear Vice President Dhankhar. I am also very sad. They should not talk to any party.
Sibal said, ‘People will remember that when the Supreme Court verdict about Indira Gandhi’s election came, only one Justice Krishna Iyer ruled. Indira was removed from the post of MP. Then Dhankar ji was accepted by this, but now the decision of the bench of two judges is being questioned against the government.
Dhankhar had said- courts cannot order the President
In fact, Vice President Jagdeep Dhankhar objected to the advice of the Supreme Court on Thursday, in which he had set a deadline for the President and the Governors to approve the bills.
Dhankhar said that the courts cannot order the President. He said that under Article 142 of the Constitution, the special right to the court has become 24×7 available nuclear missile against democratic powers. The judges are acting like a super parliament.
Sibal said- the country trusts the judiciary Sibal said- In today’s time, if an institution is trusted in the whole country, then it is a judiciary. The Supreme Court has gained the strength of Article 142 from the Constitution.
In such a situation, if someone has any problem, then they can exercise a review by exercising their rights. They can also ask for advice from the Supreme Court under Article 143. Article 142 empowers the Supreme Court to give any order, instructions or decision to perform full justice.
Controversy started with this decision of Supreme Court The Supreme Court had fixed the ‘limit’ of the Governor’s authority in the case of the Tamil Nadu Governor and the State Government on 8 April. A bench of Justice JB Pardiwala and Justice R. Mahadevan had said, “The Governor has no veto power.” The Supreme Court also termed the government’s 10 essential bills being stopped by the Governor as illegal.
During this decision, the court also clarified the situation on the bill sent by the Governors to the President. The Supreme Court had said that the President would have to take a decision on the bill sent by the Governor within 3 months. The order was made public on 11 April.

Addressing the trainees of the Rajya Sabha, the Vice President said on April 17 that we have judges who will enact laws, who will do executive work, who will also act as ‘Super Parliament’. They will not have any accountability, because the law of the country does not apply to them.
‘In democracy, the elected government is the most important and all institutions should work within their respective limits. No institution is above the constitution.
Why did the FIR not have been done so far in the case of unjust cash of Justice Verma’s house? Are some people above the law? The Supreme Court has formed an in-house committee of three judges to investigate this case. It has no constitutional basis. The committee can only give recommendation, but Parliament has the right to action.
‘If this matter had been the house of a common man, by now police and investigative agencies would have become active. The judiciary has always been a symbol of respect, but delay in this matter, people are confused.
