According to the Department of Homeland Security, Singh was not a legal immigrant and ICE has taken a detainer against him following his arrest. Singh entered the US illegally through the southern border in 2022 and was released under the Biden administration’s “alternative to detention” policy while awaiting an immigration hearing, Fox News reported. According to Fox News report, federal law enforcement sources have confirmed that Singh was encountered by the US Border Patrol in the El Centro sector of California in March 2022 and was released into the interior of the country pending an immigration hearing.

As CBS News reports, the crash involved eight vehicles – including four commercial trucks – and resulted in three people dying and four being hospitalized. As the case progresses, Singh remains in custody in San Bernardino County without bail, and his next court appearance is scheduled for Thursday in Rancho Superior Court in Rancho Cucamonga.
California Highway Patrol (CHP) officials told CBS that an investigation is ongoing into whether Singh had a valid commercial driver’s license at the time of the crash.
Visa review to strengthen background checks for commercial drivers
In August, the US government temporarily stopped issuing worker visas for commercial truck drivers. According to CBS News, a State Department spokesperson said the decision was made in response to a “comprehensive and thorough review” of the screening and verification processes used to assess applicants’ eligibility for U.S. visas.
CBS quoted a State Department spokesperson as saying, “As we have seen in recent fatal crashes, foreign truck drivers can pose a threat to American lives, US national security, and foreign policy interests.”
In August, Harjinder Singh, an undocumented immigrant from India, attempted to make an illegal U-turn on the Florida Turnpike in St. Lucie County, killing three people. According to US Marshals, Singh had obtained a commercial driver’s license (CDL) from California, despite being in the country illegally.
Florida has taken legal action by filing a lawsuit against California and Washington over a fatal crash. The lawsuit alleged that California and Washington did not comply with federal security and immigration-status requirements in issuing commercial driver licenses.
