Delhi High Court has given important instructions in a case related to personality rights of actor Hrithik Roshan. Let us tell you that due to the actor’s name, photos and videos being used for commercial purposes without his permission.Had approached the court.
As per the information available, the court has directed to remove links and listings on certain e-commerce and internet websites which were linked to the commercial use of Roshan’s image and name without his permission. At the same time, the court refused to grant an immediate stay against the Instagram page and fan clubs. Justice Manimeet Pritam Singh Arora clarified that if fan pages are being used for non-commercial purposes and do not contain any defamatory material, they cannot be removed.
Senior advocate Sandeep Sethi told the court that Roshan’s photographs and name were being used to sell bags, clothes and other merchandise. Moreover, her videos are being used unauthorizedly for dance tutorials. The court said that the songs and performances for the dance tutorial are being used for non-commercial purpose and are available in the public domain, hence its immediate removal is not appropriate. However, the court directed the removal of AI generated content related to the actor.
It is noteworthy that this case is related to Roshan’s personality rights and publicity rights, in which unauthorized use of his name, voice, image and other characteristics has been alleged. The court will also hear other similar cases such as the case of singer Kumar Sanu in the coming days. In the recent past, the court has also ordered protection of personality rights of journalist Sudhir Chaudhary, Art of Living founder Sri Sri Ravi Shankar, Telugu actor Nagarjuna and Bollywood stars Aishwarya Rai Bachchan, Abhishek Bachchan and filmmaker Karan Johar.
According to the available information, senior advocate Sandeep Sethi along with advocates Niam Pasa, Parag Khandahar, Chandrima Mitra, Tapan Radkar, Pratyusha Dhodda, Krishna Kumar and Siddharth Kaushik were present on behalf of Roshan in this case.
