The Supreme Court on Friday (September 26) asked the central government to decide on amending the complete ban on the construction of firecrackers in the Delhi-National Capital Region after consultation with all the stakeholders. Meanwhile, the court allowed the manufacturers of certified green firecrackers, who have permits from NEERI and PESO, to make green firecrackers in Delhi-NCR, provided that they are not sold in NCR. The court said that in the meantime, we allow the manufacturers to make crackers who have green crackers certified by Neeri and PESO. However, for this, the manufacturers will have to promise before this court that until the next order passed by this court, they will not sell any of their firecrackers in prohibited areas.

The court will hold the next hearing on the matter on 8 October. The order was passed by a bench of Chief Justice of India BR Gawai, Justice K. Vinod Chandran and Justice NV Anjaria in the MC Mehta case. During the hearing, some parties argued that the order passed by the court on April 3 in which the ban on firecrackers in NCR was extended for the whole year instead of the winter season – opposite to the 2018 verdict in the Arjun Gopal case. The bench said that she does not propose to consider the issue at this time.

The bench said in its order that complete ban cannot be practical and ideal. In this regard, the bench said that illegal mining mafias have emerged due to complete ban on mining in Bihar. During the hearing, Justice Senior Advocate Aparajita Singh, in the MC Mehta case, advocated a complete ban on firecrackers, including their construction. He said that allowing construction in NCR would eventually promote their sales and use in restricted areas. On behalf of the makers, senior advocate Balbir Singh (Assistant Advocate Devansh Srivastava) and K.K. God demanded permission to construct with strict conditions. He said that they can announce quantity on the website and make all the necessary announcements.
