E-cigarette in Netflix series: FIR preparation on Ranbir Kapoor and OTT platform, strict order of NHRC

The National Human Rights Commission (NHRC) has issued a notice to the Ministry of Information and Broadcasting and the Mumbai Police Commissioner in view of the complaint, alleging that a popular actor in the web series ‘Bads of Bollywood’ released on an OTT platform has been shown using a banned e-cigarette without any warning or discontent.

According to information received from the case’s proceedings, the complainant has alleged that the scene was “shown openly”, which allegedly promoted the use of such banned substances and misled the young audience or negatively impressed. There was no immediate response from the ministry or over-the-top (OTT) platform ‘Netflix’.

The National Human Rights Commission has said that the officials should be instructed to investigate the allegations made in the complaint and submit action reports within two weeks for the commission’s observation. This complaint has been lodged by human rights activist Vinay Joshi. It is alleged that Netflix’s web series Bads of Bollywood, well-known actor Ranbir Kapoor, is shown using a banned e-cigarette without any warning or disruption.

The NHRC said that the allegations made in the complaint seem to be a serious violation of the laws prima facie. A bench headed by NHRC member Priyank Kanungo heard the case and issued notices.

The proceedings stated that a bench headed by NHRC member Priyank Kanungo has taken cognizance under Section 12 of the Human Rights Protection Act, 1993.

In addition, the incident is a clear violation of Section 4 and Section 7 of the Electronic Cigarette Prohibition Act, 2019. It is appropriate to mention here that Section 4 banns the storage, use and promotion of e-cigarettes in any form, and Section 7 punishes individuals and companies who advertise such banned products. The registry has been directed to issue a notice to the Secretary of the Ministry of Information and Broadcasting to “take appropriate action and immediately stop the material that can affect the younger generation incorrectly.”

In the notice, Mumbai Police Commissioner has also been asked to take appropriate legal action, including registering an FIR, including filing an FIR as per the procedures prescribed against actor Ranbir Kapoor and other individuals/companies, which include the manufacturer/construction company, OTT platform Netflix, which contains an advertisement in electronic cigarette prohibition acts, 2019 and other applicable crime, Publicity is involved.
