The political stir has increased before the Bihar elections. The Supreme Court has given its verdict on the SIR issue of the Election Commission in Bihar. The Supreme Court ordered the Election Commission that the Aadhaar card should be considered a valid identity card. But here the Election Commission has clarified that it will not be the basis of citizenship. The Supreme Court has recognized it with 11 other documents. Now Aadhaar will be included in the SIR as the 12th document.

Actually, the election time in Bihar is getting closer. Prior to the election, the Election Commission in Bihar, the process of SIR, which was aimed at identifying fake photos. During this time, the Election Commission had made a list of 11 documents to identify voters. On the basis of which voters could prove their citizenship. In the end, about 60 lakh voters in Bihar could not prove their identity. But the Election Commission had set a September deadline for all such voters. Now RJD and AIMIM demanded to increase this deadline. On which the Supreme Court told the Election Commission that this deadline should continue even after September 1. The Supreme Court clearly stated that Aadhaar is another document with 11 documents.

The court directed the Election Commission that the Aadhaar card should be considered as the 12th document, which can be entered in the voter list by presenting an identity proof. This means that the Aadhaar card will now be acceptable alone as the other 11 documents as a proof. The court asked the Commission to issue necessary instructions so that Aadhaar could be accepted for identity proof. The court said that the Aadhaar is not a proof of citizenship as per the Aadhaar Act, but keeping in mind Section 23 (4) of the Representation of the Public Representation Act is a valid document to establish a identity. The court recorded the statement of the Election Commission in a record that the Aadhaar card would be accepted as an identity proof.

Also, the officials of the Commission will have the right to check the authenticity and reality of the Aadhaar card presented. Justice Bagchi commented that out of the 11 documents mentioned by the Election Commission, there was no evidence of any citizenship except passports and birth certificates. A bench of Justices Suryakant and Justice Joymalya Bagchi passed the order after hearing the arguments of RJD and other petitioners. He said that Election Commission officials were not accepting the Aadhaar card as a document alone and insisting on presenting one of the 11 documents mentioned in the SIR notification. On behalf of RJD, senior advocate Kapil Sibal argued that despite three orders from the Supreme Court, Election Registration Officer and Booth Level Officer (BLOS) are not accepting Aadhaar. If they do not accept it, what kind of enrollment is this practice? They want to exclude the poor.
