Union Home Minister Amit Shah on Wednesday introduced a controversial bill in the Lok Sabha, proposing that if an existing minister, Chief Minister or even the Prime Minister is arrested or detained for 30 consecutive days for jail sentence of five years or more, he may have to lose his position within a month. Amit Shah introduced the Constitution (one hundred and thirtyth amendment) Bill, 2025, Union Government (Amendment) Bill, 2025, Jammu and Kashmir Reorganization (Amendment) Bill, 2025 in the Lok Sabha. However, during this time the opposition’s strong uproar continued. The opposition strongly opposed this bill.

What is the bill
According to the statement related to the objectives and reasons of the Union Territory Government (Amendment) Bill 2025, there is no provision to remove the Chief Minister or Minister arrested for arrested and detained due to serious criminal allegations under the Union State Government Act, 1963 (20 of 1963). In such cases, there is a need to amend Section 45 of the Union Territory Government Act, 1963 to provide a legal framework to remove the Chief Minister or Minister. The Bill tries to achieve the above objectives. According to the objectives of the Constitution (130th Amendment) Bill, 2025, there is no provision to remove the minister arrested and detained in serious criminal charges under the Constitution, so in such cases there is a revision in such cases to provide a legal structure to the Prime Minister or Union Council of Ministers and the Chief Minister of the State and the Chief Minister and National Capital Region Delhi or the Chief Minister of Delhi or the Minister of Delhi, and a revision of the Constitution with a revision of 75, 164 and 239 AAs of the Constitution. Need The purpose of the Bill is to achieve the above objectives.

The Constitution (130th Amendment) Bill provides that if a Prime Minister, Chief Minister or Minister remains in judicial custody for 30 consecutive days, he will be removed from the post automatically. However, the crime for which he has been detained should be punished five years or more. Thus, even if they are not convicted, they can still be removed from their positions. This law brings them equal to government employees who are suspended when arrested.
