Aparajita Bill of Bengal stuck, governor told death penalty ‘inconsistent’

A highly placed source in Raj Bhavan said that West Bengal Governor CV Anand Bose has sent the Aparajita Bill back to the state government to consider the serious objections raised by the Center on the proposed changes in the Indian Justice Code. The source said that the Center in its remarks found that Aparajita Women and Child (West Bengal Criminal Law Amendment) Bill, passed in the Assembly in September 2024, demands a change in punishment for rape under several sections of the Indian Justice Code which is highly rigid and inconsistent.

However, the state government said that it has not yet received any information from the Central Government or Governor’s Office regarding its comments on some provisions of the bill. The Bill proposes to increase the punishment for rape from the existing minimum 10 years to the rest of life for life imprisonment or death under BNS. The Ministry of Home Affairs (MHA) has described several provisions of the bill as problematic. After looking at the comment of the Ministry of Home Affairs, the Governor has sent him to the state government for proper consideration.

He cited the comment of the Ministry of Home Affairs, saying that the Center has extended the sentence for rape from a minimum of 10 years and described the proposal of amending BNS to amend BNS for life imprisonment or death penalty for the rest of the life of the guilty.
