Former Jawaharlal Nehru University (JNU) scholar and activist Omar Khalid approached the Supreme Court and challenged the Delhi High Court’s order to refuse to bail under the illegal conspiracy (prevention) Act case in the national capital in the national capital. It is now reported that the bail plea of 4 accused including Omar Khalid-Sharjil Imam will be heard in the Supreme Court on September 12.

The Delhi High Court on September 2 dismissed a bail petition of nine people, including Khalid and Sharjil Imam in the case, and said that “conspiratory” violence cannot be allowed under the guise of protests or protests of citizens. The High Court had dismissed the bail petition of other accused, including Mohammad Salim Khan, Shifa Ur Rehman, Athar Khan, Miran Haider, Abdul Khalid Saifi, Gulfisha Fatima and Shadab Ahmed. Khalid, a social worker and alumnus of JNU, has been in jail since the Delhi Police was arrested on September 14, 2020 for alleged involvement in the Delhi riots case. He was booked under a very strict UAPA Act for allegedly having a big conspiracy behind the Delhi riots. He denied the allegations and described himself as innocent in the case.

Khalid had earlier knocked out the door to the apex court in October 2022, challenging the Delhi High Court verdict in which he was refused to bail. Since then, he has been in jail and despite his best efforts and continuous appeal in various courts, he never got bail. He initially sought a bail in the Delhi High Court on the basis that he had neither a “criminal role” in the violence in the north-eastern area of the city nor had any conspiratorial relationship with any other accused in the case. Delhi Police opposed Khalid’s bail petition in the High Court.
